These Terms of Service ("Terms") explain how you may use H-AI-LEY (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Overview

H-AI-LEY is an educational AI tutor operated by HRB Studios ("we", "us", "our"). The Service is designed to help people learn, practice, and better understand academic and practical topics.

By using the Service, you confirm that you have read and agree to these Terms and our Privacy Policy.

2. Eligibility & Age Requirements

  • The public edition of H-AI-LEY is intended for users 13 years and older.
  • You must be at least 13 years old to create an account. We do not knowingly allow children under 13 to sign up or use the Service.
  • If you are between 13 and 17, you should use the Service only with the permission and understanding of a parent or legal guardian, especially for any paid plans.
  • Parents may create and manage child profiles under a parent account where available. Parents are responsible for supervising how their children use the Service.
  • If we become aware that an account was created by someone under 13, we may deactivate that account and delete associated data where appropriate.

3. Accounts & Security

  • You agree to provide accurate information when creating an account, including a valid email address and first name.
  • You are responsible for keeping your login details secure and for all activity that occurs under your account.
  • If you believe your account has been accessed without your permission, you should change your password and contact us as soon as possible.

4. Educational Use Only (No Professional Advice)

  • H-AI-LEY is an educational tool. It is not a substitute for professional advice or services.
  • The Service does not provide licensed professional advice (including medical, legal, financial, mental health, or other professional advice).
  • The Service is not an emergency or crisis service. If you or someone else is in danger or needs urgent help, contact local emergency services or a trusted professional immediately.
  • You are responsible for how you use any information provided by the Service, and you should always double-check important decisions with qualified professionals or trusted sources.

5. AI Limitations & Accuracy

  • The Service uses AI models that generate responses based on patterns in data. While we aim to provide helpful and accurate information, AI systems can make mistakes, be incomplete, or misinterpret your question.
  • The Service may occasionally provide incorrect or outdated information.
  • You should treat AI responses as educational guidance, not guaranteed facts.
  • You are responsible for verifying information before relying on it for important decisions, assignments, exams, or professional use.

6. Acceptable Use & Academic Integrity

You agree to use H-AI-LEY in a respectful, safe, and honest way. In particular, you agree that you will not:

  • Use the Service to cheat on tests, exams, graded assignments, or other assessments where outside help is not allowed.
  • Use the Service to create, request, or share illegal, harmful, violent, hateful, or sexually explicit content.
  • Attempt to bypass or disable safety filters, rate limits, or access controls.
  • Harass, threaten, or bully others through your use of the Service.
  • Attempt to reverse engineer, copy, or misuse the Service in ways that violate these Terms or applicable law.

We may limit or suspend access for accounts that repeatedly or seriously violate these rules.

7. Free Trial, Subscriptions & Billing

  • We may offer a limited free trial (for example, a 20-message trial) so you can test H-AI-LEY before subscribing.
  • Trial availability, limits, and features may change over time.
  • Paid plans (such as Solo or Parent plans) are handled through our payment provider (for example, Stripe). We do not receive or store your full payment card number on our servers.
  • Plan prices, billing cycles, and refund rules will be shown clearly on the checkout or billing page.
  • By starting a paid plan, you agree to the pricing and billing terms shown at checkout. You can typically cancel future renewals through your account or by contacting support.

8. Third-Party Services & Data Practices

To provide the Service, we rely on carefully selected third parties, such as AI providers, payment processors, and basic analytics tools. For example:

  • AI provider (currently OpenAI) processes your prompts and the model's responses so the tutor can reply. The AI provider may temporarily log inputs and outputs for abuse detection, security, or system monitoring, under their own terms and policies.
  • Payment processor (e.g., Stripe) handles subscription payments and billing. We do not store your full card number.
  • Analytics (if enabled) may be used in a limited way to understand basic usage patterns (for example, which major features are used) so we can improve the Service. We aim to use aggregated or anonymized data where possible.

On our side, we try to collect and retain only the minimum data needed to operate H-AI-LEY: account information (such as email and hashed password), basic profile and trial counters, and limited safety or technical metadata. We do not store full conversation histories for long-term profiling or marketing in the public edition.

9. Intellectual Property

  • The H-AI-LEY name, branding, website design, and underlying code are owned by HRB Studios or its licensors.
  • You may not copy, resell, or present the Service as your own.
  • Content you type into the Service remains yours. You grant us a limited, worldwide license to process that content only as needed to operate, secure, and improve the Service (for example, to generate responses, enforce safety rules, and maintain essential logs).

10. Suspension & Termination

We may suspend or terminate access to the Service if we reasonably believe:

  • you have seriously or repeatedly violated these Terms;
  • your account is being misused or compromised; or
  • we are required to do so by law, safety concerns, or technical issues.

You may stop using the Service at any time. If you want your account deleted, you can contact us as described in the Privacy Policy.

11. Disclaimers & Limitation of Liability

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent allowed by law, we do not guarantee that:

  • the Service will be error-free or uninterrupted;
  • the information provided will be perfectly accurate or complete;
  • the Service will meet every specific need or expectation.

To the extent allowed by law, HRB Studios and its owners are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Where liability cannot be excluded, our total liability will be limited to the amount you paid for the Service in the three (3) months before the claim arose (if any).

12. Changes, Governing Law & Disputes

We may update or modify the Service over time, such as adding new features, changing limits, or fixing bugs. We may also update these Terms. When we do, we will change the “Last updated” date at the top of this page and may provide additional notice if the changes are significant.

If you continue using the Service after the updated Terms take effect, you are agreeing to the new version.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where a different law is required by your local regulations.
